By registering as a member, or by using the Services in any way, you agree to be bound by these Terms of Service, together with our Privacy Policy and Cookie Policy. Together, these documents form a legally binding contract between you and Viz4D.

You also confirm that you have read and understood our Privacy Policy, available at https://viz4d.com/privacy. The Privacy Policy, which explains how we collect and use your personal data, is incorporated into these Terms of Service.

By accessing or using the Services, you consent to the collection and use of your information in accordance with the Privacy Policy and these Terms. If you do not agree to these Terms or to any additional terms that may apply, you may not access or use the Services.

Viz4D reserves the right, at its sole discretion, to amend these Terms at any time by posting a notice on this page. Any such modifications will become effective immediately upon posting. Therefore, you should review this page periodically for updates. Your continued use of the Services after any updates or amendments constitutes your acceptance of the amended Terms.

To use Viz4D Services, you must represent and warrant that you are over 18 years of age or, if you are between 13 and 18, that you are an emancipated minor or have valid parental or guardian consent, and that you are fully able and competent to abide by and comply with all the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement. This provision is void where prohibited by law, and the right to access the Services is revoked in such jurisdictions.

By using the Services, you represent that you can form a binding contract with Viz4D and that you will comply with these Terms as well as all applicable local, state, national, and international laws, rules, and regulations.

If you are using the Services on behalf of a business or another entity, you represent that you are authorized to grant all licenses set out in these Terms and to agree to these Terms on behalf of that business or entity.

You represent and warrant that you have the legal right to use the Paddle account, and any bank accounts or credit card accessed through the Paddle account, that you use to pay for the service. You agree to pay all charges incurred by you or any users of your account at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases. Verification of information applicable to a purchase may be required prior to our acceptance of any order.
If you are using the Services on behalf of a business or some other entity, you state that you are authorized to grant all licenses set out in these Terms and to agree to these Terms on behalf of the business or entity.
Plan options and prices of all Services are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Viz4D website (Viz4D.com) or the Services.
Technical support for the Services is only provided to paying account holders and is available via email and/or live chat (depends on plan). Support is available in English and Vietnamese.
If the Services are subject to taxes, fees, or charges, Viz4D may charge you for those taxes, fees, and charges in addition to the cost of the Services (collectively, “Charges”), and you agree to pay Charges at the rates in effect when incurred.

You can change your Plan at any time in Account Settings. As soon as you finish paying for the new Plan, any changes will happen immediately:

• All benefits and features will follow the new Plan.
• The expiry date is reset based on the new payment date.
• The previous Plan's unused triangles will be rolled-over to the new Plan. The previous Plan's unused Credits can be used during the first 15 days of your next Plan. If your old Plan expires and you still don't purchase a new Plan, your remaining Credits will also expire instead of rolling over. We do not generate any refunds when you change your Plan.

Changing your Plan may affect the Active scene capacity of your account. Viz4D does not accept any liability for such loss.
Plan expires:
If you do not purchase a new Plan when the old Plan has expired, your account will automatically go into a waiting period with the same features as the FREE Plan. There are only 5 Active scenes in the FREE plan, all other scenes will be stored in Inactive mode (viewable only by account Owners).
FREE accounts after 24 months of inactivity might be permanently deleted from the system. Before your data is completely erased, you can always purchase a plan to maintain all your scenes and reset the 24 months counter.

By using the Services, you agree that, in addition to exercising common sense:

• You will provide a valid email address and any other information requested to complete the signup process.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all content posted and all activity that occurs under your account (including content posted by others who have access through your account plan).
• You will not create another account if your current account has been disabled, unless you have received written permission from us.
• You will not register accounts through non-human means, such as “bots” or other automated methods, as such methods are strictly prohibited.
• You will not use your account for any illegal or unauthorized purpose.

Viz4D retains the right, at its sole discretion, to deactivate, reallocate, or rename your username at any time. We also reserve the right to terminate the accounts of any Service User who has been notified of infringing activity on more than two occasions.

The use of Viz4D in advertisements, marketing, or advertiser-supported content requires a Premium Scene. The use of FREE Scenes for such purposes is strictly prohibited.

+ Account Deletion:
You may terminate these Terms and your use of the Services at any time, for any reason, by deleting your account. Such deletion will take effect immediately, and access to your account will end at that time (the “Cancellation Effective Date”). You will not be entitled to a refund. Upon the Cancellation Effective Date, all of your content will be permanently deleted from the Services and cannot be recovered by you or Viz4D.

Viz4D grants you (as a permitted user) a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Services in accordance with these Terms and in compliance with all applicable laws. Any use of the Services beyond the scope of access authorized by these Terms will immediately terminate this license. You are solely responsible for ensuring that your use of the Services complies with the laws of your specific jurisdiction.

The license granted to you is subject to the following restrictions, in addition to others listed in these Terms.

You may not, and you may not cause or assist others to:

• Download or copy any Content for any purpose without prior express written permission from Viz4D.
• Decompile, reverse engineer, or attempt to extract the source code of any software used in our Services.
• Reproduce, duplicate, copy, sell, resell, lease, or otherwise exploit any portion of the Services (including any portion of the code, visual design elements, or concepts) without express written permission from Viz4D.
• Modify, create derivative works from, or disassemble the Services for any reason, including for the purpose of creating competitive products or services.
• Resell any Content, or include any Content in or with any product you create or distribute.
• Use the Services in any manner that could damage, disable, overburden, impair, interfere with security, negatively affect functionality, or otherwise abuse the Services or any related systems, accounts, servers, networks, or affiliated/linked sites connected to or accessible through the Services (including, without limitation, uploading, posting, or otherwise transmitting any viruses, trojan horses, worms, or other harmful or disruptive files or programs, or imposing an unreasonable or disproportionately large load on our infrastructure).
• Use any robot, spider, or other automated device or program, or any manual process, to monitor, copy, summarize, or otherwise extract information from the Services or Content, in whole or in part.
• Use the Services in any manner that may dilute, tarnish, or otherwise harm our name, reputation, trade names, or trademarks, or those of our affiliates or partners.
• Attempt to circumvent any content-filtering techniques we employ, or attempt to access areas or features of the Services you are not authorized to access.
• Interfere with another person’s use and enjoyment of the Services or of the Internet generally.
• Solicit login credentials from another user.
• Use the Services for purposes other than those for which they were designed.

Users are not permitted to modify the design or alter the appearance of the Viz4D viewer (including but not limited to embeds, screen recordings, or screen captures), except through the Add-Ons available in Premium Scenes. For Free Scenes, removing, hiding, or altering the Viz4D logo watermark is strictly prohibited.

Except as expressly permitted in these Terms, you may not reproduce, distribute, adapt, modify, translate, create derivative works from, publish, or otherwise use any portion of the Services or Viz4D Content without prior express written permission from us or the applicable rights holder. Any commercial exploitation of the Services or Viz4D Content without such prior written permission is strictly prohibited.

We reserve all rights not expressly granted to you.

You agree that you will not use the Services to post, share, submit, or upload any content (including User Original Content) that:

• Abuses, whether verbally, physically, or in writing, or threatens to abuse (including actual or threatened retribution) any Viz4D customer, employee, member, or officer.
• Promotes any illegal activity, or advocates, promotes, or assists in any unlawful act.
• Uploads, posts, hosts, or transmits unsolicited email, SMS, or other “spam” messages.
• Violates the legal rights of others (including rights of publicity and privacy), or contains material that could give rise to civil or criminal liability under applicable laws or regulations, or that otherwise conflicts with these Terms of Use or our Privacy Policy.
• Employs misleading information, such as false email addresses, forged headers, or otherwise manipulated identifiers, in order to disguise the origin of content transmitted through the Services.
• Transmits any material or content that is pornographic, dehumanizing, threatening, harassing, libelous, hateful, defamatory, racist, xenophobic, harmful, or otherwise illegal.
• Transmits material or content that promotes, provides, or relates to instructional information about illegal activities, or that encourages physical harm or injury against any individual or group.
• Transmits or encourages the transmission of any material that infringes the intellectual property or other rights of third parties, including trademark, copyright, patent, or rights of publicity, or that otherwise constitutes or promotes counterfeit goods or materials.
• Harasses, bullies, defames, or threatens any person, or promotes self-harm.
• Encourages or promotes any activity that violates these Terms.

Notwithstanding anything contained herein, we reserve the right to refuse access to the Services to anyone, at any time, for any reason, without notice or liability. If you breach your obligations under these Terms, we may investigate conduct that may involve violations of law and cooperate with law enforcement authorities in prosecuting users involved in such violations. We also reserve the right at all times to disclose any information (including, without limitation, your personal information or identity) regarding your use of the Services, as permitted or required by applicable law, including in connection with any suspected violations.

This section applies solely to the Viz4D Mesh, where original 3D scenes and related content are uploaded to Viz4D servers for processing. For the Viz4D Fusion, processing occurs locally on the user’s device, and original 3D scenes are not uploaded to Viz4D servers; therefore, the provisions of this Section do not apply to Viz4D Fusion.


We do not claim ownership of any intellectual property rights in the materials or content you provide to or through the Services or to any third party. Your profile and the materials and content uploaded by you remain yours, including all content from “users and collaborators authorized by you,” such as original 3D scenes, textures, maps, lightmaps, LUTs, animations, comments, documents, images, videos, audio, and URLs.

Ownership of your uploaded original 3D scene remains with you, and security is assured by the automatic deletion of your uploaded original 3D scenes from our servers after processing. (Seven days after processing is complete and you have agreed to publish, your original 3D scene will be permanently deleted from the system.)

The 3D scenes published on the Viz4D service (or website) are simplified, compressed, and transformed versions generated by Viz4D and are part of Viz4D Content. The right to use data after processing belongs to the account owner: you have full rights to access, edit, delete, grant access, and otherwise manage your interactive scenes, provided you do not violate these Terms of Service.

You are solely responsible for the content of, and any harm resulting from, any content you post, upload, link to, or otherwise make available through the Services (your “User Original Content”), regardless of its form. We are not responsible for any public display or misuse of your or any other user’s User Original Content.
You represent and warrant to us that you own, or have obtained all necessary licenses and permissions to use, any User Original Content that you submit to Viz4D, and that such User Original Content does not infringe the intellectual property or personal rights of others, or violate any applicable law or regulation.
You accept full responsibility for avoiding such infringement or violation in connection with your User Original Content.

Although Viz4D does not claim ownership of content posted by users, by uploading or posting content to our Services, you automatically grant—and represent and warrant that you have the right to grant—to Viz4D a non-exclusive, royalty-free, fully paid-up, irrevocable, perpetual, worldwide license to use, optimize, create derivatives, modify, copy, reproduce, adapt, publish, perform, display, store, distribute, translate, communicate, and make available to the public your User Original Content, and to create compilations and derivative works from such content, in connection with the operation or use of the Services.
Only content processed using Free Credits may be used for training purposes.

You further grant Viz4D the right to use your name and trademarks, if any, in connection with our use of your publicly shared User Original Content. To the fullest extent permitted by law, you irrevocably waive any and all moral rights, or any similar rights, in your User Original Content, including the right of integrity. To the extent that you retain any such rights under applicable law, you agree not to assert them against Viz4D, its affiliates, or other Viz4D users in any manner.

You are solely responsible for your User Original Content under applicable laws, including but not limited to third-party intellectual property and privacy rights. You agree that any information included in your User Original Content may be used in accordance with our Privacy Policy. Viz4D reserves the right, in its sole discretion, to accept or reject any User Original Content.

By submitting User Original Content, you represent and warrant that:

• You own and control all rights to your User Original Content.
• Viz4D will not need to obtain licenses from or pay royalties to any third party.
• The use of your User Original Content does not violate this "Terms of use" or the law, and will not violate any rights of or cause injury to any person or entity.
• You agree that you bear all risks associated with your User Original Content. You are solely responsible for safeguarding your User Original Content, and Viz4D has no duty to store copies of User Original Content.
• If properly notified that User Original Content infringes on the intellectual property rights of others, Viz4D will first hide and may then delete User Original Content from the Service. We reserve the right to remove or hide User Original Content from the Service, in whole or in part, without prior notice, for any reason or no reason at all.
• We may moderate, edit, modify, reformat, change or remove all or part of the descriptions, comments and/or comments that You and/or third parties add and/or conduct in connection with your User Original Content, in any way we may identify, whenever we find it appropriate.
• Viz4D does not pre-screen content, but may do so at its sole discretion. Viz4D may, but has no obligation to, remove or suspend content and accounts containing content that we determine in our sole discretion is unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms. If necessary, we may also remove content to comply with our legal obligations.

You acknowledge and agree that Viz4D may disclose your User Original Content and related information if required to do so by law, or in the good-faith belief that such preservation or disclosure is reasonably necessary to:

• Comply with legal process, applicable laws, or government requests;
• Enforce these Terms;
• Respond to claims that any of your User Original Content violates the rights of third parties;
• Detect, prevent, or otherwise address fraud, security, or technical issues; or
• Protect the rights, property, or personal safety of Viz4D, its end users, or the public.

You agree to inform Viz4D promptly about any legal complaint, claim, or action related to the User Original Content you have uploaded using the Services.

Viz4D Content includes all derivative 3D models (simplified, transformed, compressed versions), textures, UV maps, lightmaps, videos, images, audio, LUTs, post-processing outputs, and other materials created by altering the presentation format, applying transformations, or optimizing from the original 3D scene. It also includes all elements, software, applications, functions, images, text, information, data, graphics, and other materials provided on or otherwise made available through the Services, excluding User Original Content.
The 3D scenes published on the Service (or on the Viz4D website) are simplified, transformed, and compressed versions generated by Viz4D, and are therefore part of Viz4D Content. These versions are low-poly, optimized to intentionally distorted levels, with the original material structures and lighting settings entirely removed. Textures are resized and reformatted to alter color and format, making them unusable outside the Service.

Viz4D Content is owned by Viz4D or its licensors, and is protected by international copyright laws, trademark laws and/or other proprietary rights and laws. Viz4D and its licensors own all right, title and interest ( including but not limited to any and all copyrights, trademark rights, trade secret rights, patent rights, database rights and other intellectual property and proprietary rights therein. in each case whether registered or unregistered, and related goodwill) in and to the Service. Your use of the Services does not grant you any ownership over any Viz4D Content, and except for the limited license we grant you under this Agreement, your use of the Services does not grant you any license or permission under any copyright, trademark or other intellectual property rights of Viz4D, or any third party.

All portions of code (including but not limited to HTML, CSS, JavaScript, GLSL, WASM) as well as visual design elements, concepts, software, and software-as-a-service (SaaS) used in connection with the Services are proprietary to Viz4D or to third parties. Except as may be strictly required to exercise the limited license granted herein, any use, redistribution, sale, decompilation, de-obfuscation, reverse engineering, unpacking, disassembly, translation, or reduction of such software to human-readable form is strictly prohibited. You agree that Viz4D may update all software without notice, at any time and at its sole discretion, and that these Terms apply to all updated versions.

You acknowledge and agree that this Agreement includes the right for Viz4D to make Viz4D Content available to other users, companies, organizations, business partners, or individuals collaborating with Viz4D for syndication, broadcast, communication, distribution, publication, or other forms of public availability of Viz4D Content, whether on the Service or through other media or distribution channels. This license also includes the right for other users of the Service to use, copy, reproduce, adapt, modify, create derivative works from, publish, transmit, display, distribute, translate, communicate, and otherwise make Viz4D Content available to the public, subject to these Terms.

We reserve all rights not expressly granted to you under these Terms of Use.

Nothing in these Terms shall be construed as forming a partnership or joint venture between Viz4D and you. Neither party to these Terms will have the authority to bind the other by contract or otherwise, or to make any representations on behalf of the other. You acknowledge that Viz4D is acting independently from you, and that Viz4D will not be deemed, under any circumstances, to be your employee or agent for any purpose.

The trademark “Viz4D,” all associated logos, and other trademarks, service marks, logos, and trade names displayed on or in connection with the Services are the registered and unregistered trademarks and service marks of Viz4D or of third parties worldwide. Your use of the Services does not grant you any license or permission under any copyright, trademark, or other intellectual property rights of Viz4D or any third party. You may indicate that your application, technology, or feature developed or distributed by you that incorporates the Service (an “Application”) is “Powered by Viz4D” or “Viz4D powered.” However, unless provided in a separate agreement between you and Viz4D, you may not otherwise use “Viz4D” or any other Viz4D trademark in connection with your Application or company, or in any URL, product, service, name field, or logos created by you.
We welcome you to link to this Service. However, you agree that if you link to this Service, your website shall not:

• Alter the visual presentation of this Service
• Imply that Viz4D is endorsing you or any other person, or your (or such other person’s) products or services
• Imply an affiliation between you or any other person, or your (or such other person’s) products or services, and Viz4D without the prior written consent of Viz4D
• Misrepresent the relationship of you or any other person with Viz4D, or present false, misleading, or otherwise damaging information or impressions about Viz4D or any of its products or services

You acknowledge and agree that, in no event, will Viz4D provide any form of remuneration for any links you may make to this Service.
We reserve all rights not expressly granted to you in these Terms of Use.

If you submit ideas, drawings, recipes, suggestions, comments, or similar information to Viz4D, whether through our Service or otherwise, you do so with no expectation of confidentiality and no expectation of retaining any proprietary interest in the content of your submissions.

You agree that the content of your submissions will immediately become the property of Viz4D. You also acknowledge and agree that your submissions may be used, developed, or further refined by Viz4D or its affiliates without any obligation or compensation to you.

We respect copyright law and take reasonable steps to expeditiously hide or remove from our Services any infringing material that we become aware of. If Viz4D determines that a user has repeatedly infringed copyrights, we will take reasonable steps within our power to terminate that user’s account.
We make it easy for you to report suspected copyright infringement. If you believe that anything on the Services infringes a copyright that you own or control, please contact us immediately at [email protected] and include the following information:

• The physical or electronic signature of a person authorized to act on behalf of the copyright owner.
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material that is claimed to be infringing or the subject of infringing activity, along with information reasonably sufficient to locate the material.
• Your contact information (including address, telephone number, and email), together with a statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Access and use of our Service may be subject to limitations, delays, and other issues inherent in the use of the Internet, electronic communications, and 3D data processing in the cloud. Viz4D is not responsible for any delays, delivery failures, or other damage resulting from such problems, or from the unavailability of our Service for any reason. Viz4D makes no representations or warranties of any kind regarding the Services or the Viz4D Content.
Viz4D guarantees only one thing: if scene processing fails due to Viz4D’s technical reasons and cannot be fixed in Viz4D Editor, your scene will be reprocessed free of charge.
You expressly agree that your use of the Services is at your sole risk. The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, unless such warranties are legally incapable of exclusion. Viz4D expressly disclaims all representations and warranties, whether express or implied, including:

• All warranties of merchantability, fitness for a particular purpose, operability on any mobile device, title, non-infringement, and any warranties arising from the course of dealing or usage of trade.
• That the Services, website, and the Viz4D Content will meet your requirements, will always be available, accessible, uninterrupted, timely, secure, or operate without error.
• That any content or information you obtain through the Services will be timely or accurate. No advice or information obtained by you from Viz4D, or otherwise through the Services, will create any warranty not expressly stated herein.

If the law of the country where you live does not allow the exclusions of liability in this clause, those exclusions shall not apply.
Viz4D and its affiliates take no responsibility and assume no liability for any content that you, another user, or a third party creates, uploads, posts, sends, receives, or stores on or through our Services, whether publicly or privately. You understand and agree that you may be exposed to content that is offensive, illegal, misleading, or otherwise inappropriate, none of which Viz4D or its affiliates will be responsible for.
Nothing in these Terms will exclude or limit any responsibility we may have to remove content if required by the law of the country where you live.

The Services may contain links and features that enable you to access other third-party websites or services (“Third-Party Services”) available over the Internet. Such Third-Party Services are governed by their own terms of use. Viz4D does not control Third-Party Services and is not responsible for the content of any linked site.
You agree that it is your responsibility to review and evaluate any such content, and that all risks associated with the use of, or reliance on, such content rest with you. You are responsible for viewing, accepting, and abiding by the terms and privacy policies posted on these third-party websites.
Inclusion of a link to Third-Party Services does not imply endorsement, sponsorship, or affiliation by Viz4D. You further agree that Viz4D shall not be liable, directly or indirectly, for any loss or damage of any kind incurred as a result of, or in connection with, your use of or reliance on any third-party websites or content.
Viz4D may in no circumstances be held liable for the technical availability of Third-Party Services, or for the content, advertising, products, and/or services available on them, nor for any transactions that take place between a user and Third-Party Services to which the user has been directed via the Services. Viz4D may in no circumstances be a party to any disputes whatsoever between you and third parties concerning Third-Party Services.

You agree to indemnify, defend, and hold harmless Viz4D, its affiliates, and their respective directors, officers, employees, subsidiaries, and agents from and against any claim, demand, action, class action, investigation, or other proceeding, including but not limited to all damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys’ fees) (“Claims”), brought by any third party that arises out of or relates to:

• (a) your activities on or use of the Services;
• (b) your violation, or alleged violation, of these Terms; or
• (c) any allegation that materials you submitted to Viz4D violate applicable law or infringe any third-party rights, including intellectual property or privacy rights.

You shall not settle any Claim unless such settlement completely and forever releases Viz4D from all liability with respect to such Claim or unless Viz4D consents to such settlement in writing.

Viz4D and our affiliates, directors, officers, stockholders, employees, licensors, suppliers, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, content, use, goodwill or other intangible losses, resulting from:

• Your use of the services or inability to use the services.
• Your access to or inability to access the services.
• The conduct or content of other users or third parties on or through the services; or unauthorized access, use or alteration of your content. In no event will Viz4D or our affiliates aggregate liability for all claims relating to the services shall not exceed the total amounts paid by you to Viz4D over the six (6) months preceding your claim(s) (up to a maximum of USD 500)'

If the law of the country where you live does not allow any limitation of liability provided for in this clause, that limitation will not apply.

Viz4D reserves the right to modify ( add or remove features, products or functionalities to the Services) or stop offering all or part of the Services at any time, at its own discretion, in which case we will provide you with 30 days notice.
If you breach any provision of these Terms, the law, and/or is harmful to other users, to Viz4D, to other service or information providers, or to any third parties, then you may no longer use this Service. We, in our sole discretion, shall determine whether these Terms have been violated. You agree that we may, in our sole discretion, modify, change, cancel, terminate or suspend your account with or without notice.
Upon termination or suspension of your account, regardless of the reasons therefore, your right to use this Service immediately ceases, and you acknowledge and agree that you will not be entitled to a refund, we may immediately deactivate or delete your account and all related information and files in your account and/or ban any further access to such files or this Service. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.
After any termination and/or after you otherwise stop using the Services, Your liability in these Terms will survive and remain enforceable and in full force and effect:

• All outstanding obligations between you and us
• All your remedial liability for a breach of these Terms.

These Terms constitute the entire agreement between you and Viz4D regarding your use of the Services, and supersede any prior agreements between you and Viz4D. These Terms do not create or confer any third-party beneficiary rights.
The relationship between you and Viz4D, and these Terms, shall be governed by the laws of Vietnam, without regard to its conflict of law provisions. You and Viz4D agree to submit to the non-exclusive jurisdiction of the courts located in Hanoi.
Failure by Viz4D to exercise or enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If any provision is found unenforceable, it will be severed from these Terms without affecting the validity or enforceability of the remaining provisions.
In these Terms, the words “including”, “includes”, or variations thereof mean “including without limitation” and shall not limit the general statements that precede them.
